LEGAL AGREEMENT FOR DERMASWISS AFFILIATE PROGRAMThis is a legal agreement between you (the affiliate) and DERMASWISS or www.dermaswiss.com (the merchant). By submitting the online application, you confirm that you have read, understood, and agreed to the terms and conditions of this agreement and agree to be legally responsible for maintaining each term and condition.

  1. OBJECT OF THE CONTRACT
    DERMASWISS grants the Affiliate the non-exclusive right to promote and market DERMASWISS products in accordance with the terms and conditions set forth in this Legal Agreement.
  2.  COMMISSIONS AND PAYMENTS
    2.1 Commissions: DERMASWISS will pay the Affiliate a commission of 15% for each sale generated through the affiliate links provided by DERMASWISS.
    2.2 Payment Method: Commissions will be paid monthly, 8 days after the due date, to your account in a commercial bank in the USA or PAYPAL.
  3. AFFILIATE'S OBLIGATIONS
    3.1. The application process must be completed and submitted online. The application will be approved or rejected at our discretion. We may cancel your application if we determine that you are not suitable for our program, if:
    3.1.1 Promotes sexual materials, acts of violence, or discrimination.
    3.1.2 Promotes illegal activities.
    3.1.3 Contains software downloads that potentially allow for commission diversion from other affiliates enrolled in our program.
    3.2 Promotion: The Affiliate agrees to actively promote DERMASWISS products in an ethical and legal manner.
    3.2 Use of Materials: The Affiliate will use marketing materials provided by DERMASWISS and agrees not to modify or alter such materials without the prior written consent of DERMASWISS.
  4. AFFILIATE PANEL
    4.1. DERMASWISS will grant you access to the Affiliate account panel, where you can review the performance of your link, as well as check Commissions and Payments and Generate affiliate links. To accurately track all guest visits from your site to ours, you must use the affiliate link we provide you, through the "Generate links" tool in your account.
    4.2. DERMASWISS may, at any time, verify your location and approve the use of your links and request that you change the location or use to comply with the guidelines provided.
    4.3. Cookies will have a duration of 60 days.
    4.4. DERMASWISS may block or suspend your affiliate account at any time if fraud, abuse, or violation of any of the terms and conditions outlined herein is detected. An investigation of the matter will be conducted, and we will contact you. No affiliate commissions will be generated while your account is blocked or suspended.
  5. CONFIDENTIALITY
    Both parties agree to maintain strict confidentiality regarding all confidential information to which they have access during the duration of this legal agreement.
  6. DURATION AND TERMINATION
    This Legal Agreement will enter into force once your affiliate application is approved and will be updated every 6 months.

ACUERDO LEGAL PARA PROGRAMA DE AFILIADOS DERMASWISS

Este es un acuerdo legal entre usted (el afiliado) y DERMASWISS o www.dermaswiss.com (el comerciante). Al enviar la solicitud en línea, confirma que ha leído,  entendido y aceptado los términos y condiciones de este acuerdo y acepta ser legalmente responsable de mantener cada término y condición.

  1. OBJETO DEL CONTRATO

DERMASWISS otorga al Afiliado el derecho no exclusivo de promocionar y comercializar los productos de DERMASWISS de acuerdo con los términos y condiciones establecidos en este Acuerdo Legal.

  1. COMISIONES Y PAGOS

2.1 Comisiones: DERMASWISS pagará al Afiliado una comisión del 15% por cada venta generada a través de los enlaces de afiliados proporcionados por DERMASWISS.

2.2 Método de Pago: Las comisiones se pagarán mes vencido, 8 días después del vencimiento  a través de tu cuenta en un banco comercial de USA  o PAYPAL.

  1. OBLIGACIONES DEL AFILIADO

3.1. El proceso de solicitud debe ser completado y enviado en línea. Se aprobará rechazará la solicitud a nuestro criterio. Podemos cancelar su solicitud si determinamos que no es apto para nuestro programa, si:

3.1.1, Promueve materiales sexuales, actos de violencia, o discriminación.

3.1.2. Promueve actividades ilegales.

3.1.3. Contiene descargas de software que potencialmente permiten desvíos de comisiones de otros afiliados inscritos en nuestro programa.

3.2 Promoción: El Afiliado se compromete a promover activamente los productos de DERMASWISS de manera ética y legal.

3.2. Uso de Materiales: El Afiliado utilizará materiales de marketing proporcionados por DERMASWISS y se compromete a no modificar ni alterar dichos materiales sin el consentimiento previo por escrito de DERMASWISS. 

  1. PANEL DE AFILIADO

4.1. DERMASWISS le otorgará acceso al Panel de cuentas de afiliados, donde podrá revisar el rendimiento de su enlace, así como consultar las Comisiones y Pagos y Generar los enlaces de afiliado. Para que podamos realizar un seguimiento preciso de todas las visitas de invitados desde su sitio al nuestro, debe usar el enlace de afiliado que le proporcionamos, a través de la herramienta “Generar enlaces” de su cuenta.

4.2. DERMASWISS podrá, en cualquier momento, verificar su ubicación y aprobar el uso de sus enlaces y solicitar que cambie la ubicación o el uso para cumplir con las pautas que se le proporcionaron.

4.3. Las Cookies tendrán una duración de 60 días.

4.4. DERMASWISS podrá bloquear o suspender tu cuenta de afiliado en cualquier momento si se detecta un fraude, abuso o incumplimiento de alguno de los términos y condiciones aquí expuestos.  Se realizará una investigación del asunto y nos pondremos en contacto contigo.  No se generan comisiones de afiliado mientras tu cuenta esté bloqueada o suspendida.

  1. CONFIDENCIALIDAD

Ambas partes acuerdan mantener en estricta confidencialidad toda la información confidencial a la que tengan acceso durante la duración de este acuerdo legal.

  1. DURACIÓN Y TERMINACIÓN

Este Acuerdo Legal entrará en vigor una vez sea aprobada su solicitud de afiliado y será actualizado cada 6 meses.
